Terms of Service
These Terms of Service ("Terms") govern your use of Fieldwork, operated by Anchor Business Services LLC ("Company," "we," "us," or "our"), a Michigan limited liability company. By accessing or using fieldworkhq.io or the Fieldwork application, you agree to be bound by these Terms.
1. The Service
Fieldwork is a business operations audit platform designed for fractional consultants, fractional COOs, and independent business advisors. The service provides an AI-powered guided engagement engine, dual scoring system, report generation, and related tools for use in professional consulting engagements.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract to use Fieldwork. By using the service, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. Accounts and Access
You are responsible for maintaining the security of your account credentials. You may not share your account with others or allow others to access the service through your account. You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.
4. Subscription and Billing
Fieldwork is offered on a subscription basis. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring monthly basis. Fees are charged in advance for each billing period.
Free trial: New accounts receive a 14-day free trial. Credit card information is required at signup. You will be charged at the end of the trial period unless you cancel before the trial expires.
Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for unused portions of a subscription period.
Price changes: We will provide 30 days notice before any price increase. Continued use of the service after the effective date of a price change constitutes acceptance of the new pricing.
5. Acceptable Use
You agree to use Fieldwork only for lawful purposes and in accordance with these Terms. You may not:
- Use the service in any way that violates applicable laws or regulations
- Reverse engineer, decompile, or attempt to extract the source code or AI prompts underlying the service
- Use the service to build a competing product or service
- Share, resell, or sublicense access to the service without our written consent
- Attempt to circumvent subscription restrictions or access features not included in your plan
- Upload or transmit any malicious code, viruses, or harmful content
- Use the service in a way that could damage, disable, or impair our infrastructure
6. Client Data and Confidentiality
Information you enter about your clients during audit sessions is your data and remains your responsibility. You represent that you have obtained any necessary consent from your clients to collect and process their business information using Fieldwork.
You are responsible for maintaining appropriate confidentiality with your clients regarding the use of third-party software tools in delivering your services. We recommend disclosing your use of AI-powered tools to your clients in accordance with your professional obligations.
7. AI-Generated Content
Fieldwork uses artificial intelligence to generate audit questions, analyze responses, and produce reports. AI-generated content may contain errors, inaccuracies, or omissions. You are responsible for reviewing all AI-generated content before delivering it to clients and for exercising your own professional judgment in all client engagements.
Yield estimates and recoverable capacity figures produced by Fieldwork are estimates based on stated assumptions. They are not guarantees of outcomes. You should clearly communicate the estimative nature of these figures to your clients.
8. Intellectual Property
Our IP: The Fieldwork platform, including its methodology, prompt engineering system, scoring algorithms, UI, and brand assets, is owned by Anchor Business Services LLC and protected by applicable intellectual property laws.
Your content: You retain ownership of the data and content you enter into the platform, including client information, audit responses, and notes. By using the service, you grant us a limited license to process this content solely to provide the service to you.
Reports: Reports generated through Fieldwork, once downloaded or exported, may be used by you in your client engagements without restriction, subject to the white-label terms of your subscription plan.
9. White-Label Use
Practice plan and above subscribers may apply their own firm branding to generated reports. You represent that you own or have rights to any branding you apply. You may not represent Fieldwork-generated reports as having been produced by a different software platform without appropriate disclosure.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANCHOR BUSINESS SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Anchor Business Services LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
13. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes. Continued use of the service after changes constitutes acceptance of the modified service.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Wayne County, Michigan.
15. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
